Omilía Kids Terms of Use

1. INTRODUCTION

Welcome to Omilía Kids ("the App"), provided by Happy Path Apps, LLC ("we," "us," or "our"). These Terms of Use ("Terms") apply to the parent, guardian, or other responsible adult who sets up and manages the App ("you"). By using the App, you agree to these Terms on your own behalf and on behalf of any child who uses it with your permission. If you don't agree, please don't use the App.

2. WHAT THE APP IS

Omilía Kids offers short speech and language games for children ages 3 and up, including games for talking, listening, words, letters, and numbers. It also includes a sticker book, avatars, a breathing exercise, custom photo flash cards made by grown-ups, and progress information for grown-ups.

3. NOT THERAPY OR MEDICAL ADVICE

The App is a practice tool. It is not a medical device, and it does not diagnose, treat, or replace an assessment or therapy with a licensed speech-language pathologist or other qualified professional. If you have concerns about your child's speech, language, or development, please talk to a qualified professional.

4. WHO CAN USE THE APP

• Grown-ups: You must be at least 18 years old (or the age of majority where you live) to set up the App, create an account, or buy a subscription.
• Children: Children may use the App with the permission of their parent or guardian. You're responsible for supervising your child's use of the App.
• Teachers and therapists: If you use the App with children who aren't your own, you're responsible for having any permission from their parents that your school, practice, or local law requires.

5. ACCOUNTS

You can use the App as a guest or create an account with Sign in with Apple, Google, or email so that progress is saved across devices. You're responsible for keeping your sign-in details secure and for activity under your account. You can delete your account at any time in Settings → Delete Account.

6. SUBSCRIPTIONS

• Subscription required: After setup, the App requires a monthly or yearly subscription. Prices are shown in the App before you buy.
• Free trial: New subscribers may get a free trial. Unless you cancel at least 24 hours before the trial ends, the subscription starts and you're charged.
• Automatic renewal: Subscriptions renew automatically at the end of each period unless cancelled at least 24 hours before it ends. Your Apple ID is charged for renewal within 24 hours before the end of the current period.
• Managing and cancelling: Manage or cancel your subscription in your Apple ID settings. Cancelling stops future renewals; access continues until the end of the period you've paid for.
• Payments and refunds: All payments are handled by Apple under Apple's terms. Refund requests go to Apple.

7. YOUR CONTENT

You can add your own flash cards, including photos and words. You keep ownership of anything you add, and you give us permission to store and display it so the App can show it to you and your child. Please only add photos you have the right to use, and don't add anything unsuitable for children. Your content is private to your account; it isn't shown to other users.

8. ACCEPTABLE USE

You agree not to:

• Use the App for anything unlawful or harmful to children.
• Interfere with the App's operation or security, or try to access other users' information.
• Copy, reverse-engineer, modify, or resell the App or its content, except as the law allows.

9. PRIVACY

Our Privacy Policy explains what information the App collects, including from children, and how we use and protect it. It's part of these Terms.

10. INTELLECTUAL PROPERTY

The App, including its games, characters (such as Omi), artwork, sounds, and software, belongs to Happy Path Apps, LLC or its licensors. We give you a limited, personal, non-exclusive, non-transferable, revocable license to use the App on Apple devices you own or control, for your family's or your students' practice, as allowed by these Terms and Apple's Usage Rules.

11. DISCLAIMERS

The App is provided "AS IS" and "AS AVAILABLE," without warranties of any kind, express or implied. We don't promise that the App will be error-free or uninterrupted, or that it will produce any particular result for your child.

12. LIMITATION OF LIABILITY

To the fullest extent permitted by law, Happy Path Apps, LLC is not liable for any indirect, incidental, special, consequential, or punitive damages arising from your or your child's use of the App. Our total liability for any claim relating to the App is limited to the amount you paid for the App in the 12 months before the claim.

13. INDEMNIFICATION

You agree to indemnify and hold Happy Path Apps, LLC harmless from claims, damages, and expenses (including reasonable attorneys' fees) arising from your misuse of the App, content you add, or your violation of these Terms.

14. APPLE

These Terms are between you and Happy Path Apps, LLC, not Apple. Apple is not responsible for the App or its content, and has no obligation to provide maintenance or support for it. If the App fails to conform to any applicable warranty, you may notify Apple for a refund of the purchase price, if any; to the extent permitted by law, Apple has no other warranty obligation. We, not Apple, are responsible for addressing any claims relating to the App, including product liability, legal or regulatory compliance, consumer protection, and intellectual property claims. Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you.

15. CHANGES AND TERMINATION

We may update these Terms. If we make a significant change, we'll tell you in the App, and continuing to use the App afterwards means you accept the new Terms. We may suspend or end access to the App if these Terms are broken. You may stop using the App and delete your account at any time.

16. GOVERNING LAW

These Terms are governed by the laws of the State of Colorado, without regard to its conflict of law rules, except where the law of the country you live in gives you consumer rights that can't be waived.
